Manglona directs bank to comply with subpoena in insurance case

U.S. District Court for the NMI Chief Judge Ramona V. Manglona yesterday ordered the City Trust Bank to comply with the subpoena sent by an insurance company that is suing the owner of a clothing store for allegedly burning the establishment to claim $404,718 in insurance.

In the subpoena, FirstNet Insurance Co. seeks all documents that refer to Zheng Rui Brother Corp. or its president and sole shareholder Zhen Biao, in order “to build an acceptable model of [the defendant’s] finances.”

FirstNet subpoenaed City Trust Bank because Biao had testified that he uses the bank as his financial institution.

In her order, Manglona directed the bank to comply with the subpoena by 10am on Aug. 31, 2011.

To the best extent possible, Manglona said that FirstNet Insurance should safeguard the confidentiality of the documents produced in response to the subpoena.

“Should residual privacy concerns remain, the court encourages the parties to negotiate a stipulated protective order for the court’s consideration,” Manglona said.

FirstNet filed the lawsuit against Zhen Rui Brother Corp. to declare that it free from any obligations to the clothing storeowner.

FirstNet alleged that the fire that burned down the BL Clothing Store in Garapan on Oct. 30, 2010, was deliberately set off so the owner could claim on the insurance.

Zhen Rui Bother Corp., through counsel Ramon Quichocho, filed a counterclaim against the insurance company, alleging breach of contract and other causes of action.
