Man who beat up wife gets 12-day sentence

Superior Court associate judge David A. Wiseman has imposed a 12-day prison term on a man who beat up his wife when she joined him and his friends in a drinking session in Chinatown.

Wiseman sentenced 50-year-old Henry Pangelinan Castro to a year in prison, all suspended except for 12 days, for assault and battery, with credit for the 12 days he had already served in jail. This means Castro will no longer serve further jail time.

In an order issued last week, Wiseman placed Castro on one year of supervised probation, required him to write a letter of apology to the victim, and prohibited him from consuming any alcoholic beverages or illegal drugs during his probation.

Castro was also directed to pay a $100 fine, $100 probation fee, and $25 court assessment fee.

The Office of the Attorney General had charged Castro with assault and battery (domestic violence), disturbing the peace, and interfering with a domestic violence report. He pleaded guilty to assault and battery as part of a plea deal. The remaining charges were dropped.

Castro beat up the victim on April 17-18, 2011. According to the police report, the wife arrived at their house and saw Castro drinking with some friends outside the residence.

The victim sat at the table but her husband grabbed her shoulder, pulled her out and yelled at her to go inside. He later pulled her hair and slapped her. The friends stopped the suspect, prompting the victim to run inside the house where she called the police.

The suspect followed inside the house and grabbed the phone away from her, police said.
