Teen gets 72-hour term for pushing girlfriend who was holding infant
The Superior Court has imposed a 72-hour prison term on a teenager who pushed his girlfriend as she was holding their baby girl inside their room.
Associate Judge Kenneth L. Govendo last week sentenced the 19-year-old Ben Magofna to a year in prison, all suspended except for 72 hours, for assault and battery, and criminal mischief.
Magofna was given credit for the five days he had already served in jail. This means he will no longer serve further jail time.
Magofna will be placed on supervised probation for a year and required to undergo anger management counseling and a parenting class. He was also directed to pay a $200 fine, plus court costs and probation fees, and restitution to the victim. Govendo also ordered Magofna to perform 100 hours of community service and write a letter of apology to the victim.
The Office of the Attorney General had charged Magofna with assault and battery, criminal mischief, and disturbing the peace. Magofna pleaded guilty to assault and battery and criminal mischief as part of a plea deal. The disturbing the peace charge was dropped.
