Dentist wants $386K; clinic sues for $80K
A Canadian dentist is demanding a total of $386,000 in lost wages and damages from her former employers, while one of the employers is seeking $80,000 from her in lost income and damages.
In a joint final pretrial order issued yesterday, U.S. District Court for the NMI visiting judge Mark W. Bennett said that plaintiff Dr. Masha Maxim is seeking $94,000 in damages for lost wages for her early termination.
Maxim is also seeking an additional $292,000 in punitive damages for retaliatory discharge, said Bennett in the order agreed by the parties in the case through their respective lawyers.
Defendant Scot Thompson, on the other hand, is demanding $8,000 in lost income and at least $72,000 in punitive damages and/or compensatory damages against Maxim.
The trial will be on Aug. 15, 2011.
Maxim is suing Dental Care Inc. and its owners, Thompson and Rodney Stewart, for terminating her and for allegedly failing to make good on their promises. Thompson filed a counterclaim against Maxim for allegedly assaulting him in the clinic.
In his order yesterday, Bennett said there is no need to conduct a separate trial in Maxim’s lawsuit and Thompson’s counterclaim.
Maxim is planning at trial to go on the witness stand and call six other witnesses. The defendants will likely testify at trial and call Maxim and 15 other witnesses.
