Man in machete attack gets 6-month sentence
The Superior Court has slapped a six-month prison term on a 53-year-old man who attacked a neighbor with a machete outside a barracks in Garapan last January.
Noel Marcilino Dolde was convicted of aggravated assault and battery and was sentenced to five years in prison, all suspended except for six months, with credit for the five months he had already served in jail since his arrest.
After completing the remaining one-month sentence, Dolde will be placed on probation for five years.
Associate Judge David A. Wiseman also required him to write a letter of apology to the victim and a separate letter explaining how this conviction will affect his family.
Dolde was also directed to pay a $1,500 fine, $100 court assessment fee, plus a probation fee, and to pay $556.59 in restitution to the victim, Carlos Vela, for medical bills and in a future amount to be determined by the Office of Adult Probation.
The Office of the Attorney General had charged Dolde with assault with a dangerous weapon, and two counts of disturbing the peace.
Dolde pleaded guilty to aggravated assault and battery as part of a plea deal and as a lesser-included charge to the offense of assault with a dangerous weapon.
Dolde had attacked Vela with a machete on Jan. 7 or 8, 2011 on Saipan; the injury required stitches.
Detective Catherine B. Pangelinan stated in her report that the incident happened outside Vela’s barracks along Putting Tai Nobio Avenue.
Pangelinan said that Vela was with his girlfriend and was drinking with a neighbor, while Dolde was playing cards near them. Dolde, who was not drinking, reportedly made a joke but got mad when Vela returned the joke. Dolde took a machete from his room and hit Vela on the left arm with it.
A neighbor pulled Dolde to the side as someone then called the police.
