Harassment lawsuit dismissed

The federal court on Thursday dismissed a sexual harassment lawsuit filed by a former employee of Palms Resort Saipan after the parties reached a settlement.

Aida S. Kamruzzaman’s lawsuit was dismissed with prejudice; that means the case cannot be re-opened.

The terms of the settlement were not indicated in court papers.

Kamruzzaman filed the lawsuit on Nov. 3, 2010, against Micronesian Resort Inc. (owner of Palms Resort) and 10 unnamed co-defendants for allegedly not acting on her sexual harassment complaint against her then superior, Habib Akbar.

In Micronesian Resort’s answer to the complaint, sttorney Michael W. Dotts asserted that plaintiff’s claims are barred by the statute of limitations. Dotts argued, among other things, that the plaintiff failed to exhaust her administrative remedies before filing the lawsuit.
