Alien worker leaves barracks, not heard of since January
An alien worker left his employment in January 2009 and has not been heard of since then.
The Department of Labor referred to the Division of Immigration the case of Crispin M. Macanas, an employee of JM’s Nursery, for further action.
Macanas was found to have abandoned his employment without justification.
Labor administrative hearing officer Herbert D.Soll said JM’s Nursery owes Macanas $357.52 and that the company submitted checks in that amount to be kept in Labor’s file until such time he is found.
Soll ordered JM’s Nursery to submit a repatriation ticket for the worker to return to the Philippines and to give the ticket to the Labor hearing officer by May 25, 2009.
The hearing officer said investigation showed that Macanas left his job on Jan. 8, 2009, took his personal belongings from the barracks and has not been seen or heard from since.
Soll said the Labor investigator exhausted all means to find Macanas.
Soll said the worker has three pending paychecks for his final pay and termination compensation and he has not claimed them.
The hearing officer said Macanas is out of immigration status, has no transfer rights, and is subject to deportation.
