Alien worker files discrimination lawsuit

An alien worker has filed a discrimination lawsuit in federal court against his former employer.

MD Salam Khan, a Bangladeshi, sued Kalayaan Inc., owner of Mangkok, for discrimination, retaliation, and discriminatory termination.

Khan asked the U.S. District Court for the NMI to order the defendant to pay him back wages, overtime compensation, and damages.

Khan filed the case without a lawyer.

Saipan Tribune tried but failed to contact yesterday Kalayaan Inc. for comment.

The complaint stated that Khan worked as a kitchen helper for the defendant’s catering services in San Antonio.

He alleged that he was hired as an hourly employee at $3.55 an hour and was guaranteed 40 hours a week of work.

Khan said during the entire employment period, he was only allowed to work 40 hours or less per week and was never given overtime.

He said non-Bangladeshi employees enjoyed overtime work and compensation. The plaintiff said Filipinos and local employees were given preferential treatment.

He alleged that Filipino and local employees were allowed to eat company food provided by the defendant.

Khan said he was not given access to company food based on his religious belief.

He said his supervisor often teased him during working hours about his age.

Khan said his employer did not renew his contract, but hired a non-Bangladeshi worker after his termination.
