Car accident fatality had standing order for deportation last October

A Chuukese man who was killed when two vehicles hit him along Beach Road in Susupe Tuesday night was found to be a deportable alien since October 2008, according to records in the Superior Court.

Associate Judge David A. Wiseman issued a written decision on Oct. 31, 2008, ordering the deportation of Rodriguez Jonas Suka.

Wiseman also ordered that Suka’s travel documents, if any, be released to Immigration investigator Nick Reyes for repatriation purposes.

It was not clear why the 42-year-old Suka was still on Saipan last Tuesday despite the deportation order.

The judge issued the written order based on the Oct. 24, 2008, hearing in which the Chuukese was ordered to show cause why he should not be deported from the CNMI.

Suka appeared in court without a lawyer. Assistant Attorney General Kathleen Busenkell represented the Immigration Division.

Wiseman ruled that “by clear and convincing evidence” Suka, a citizen from the Federated States of Micronesia’s Chuuk, is a deportable alien in that he had been convicted of five misdemeanors.

Court documents show that in 1998 Suka was convicted of assault and battery, and disturbing the peace in two cases. In 2005 and 2007 he was convicted of assault and battery. In March 2008, he was convicted of violating an order of protection and disturbing the peace.

In April 2008, Immigration filed a deportation case against Suka.

Suka was pronounced dead upon arrival at the Commonwealth Health Center Tuesday night.

The two drivers were not arrested or cited after traffic investigators determined they were not under the influence of alcohol and were not speeding.

Police are still looking into whether Suka was drunk.
