Beautician gets 2 days in prison for theft
The Superior Court yesterday imposed a two-day prison term on a beautician who stole $1,490 from his employer.
Associate Judge David A. Wiseman sentenced Mario Besana to three years in prison, all suspended except for two days, for theft by deception.
Wiseman gave the 51-year-old Besana credit for the two days he has already served in jail.
Besana will be placed on three years of probation and directed to pay $1,490 in restitution to Salvador Arceo of Hair.com.
The judge also required the defendant to pay a $100 fine, $25 in court assessment fee, plus $100 in annual probation fee.
During the probationary period, Besana will be required to perform 50 hours of community service and write a letter of apology to Mr. Arceo.
The Attorney General’s Office charged the beautician with one count of theft by deception.
In the second case, the AGO charged Besana with one count of theft by unlawful taking or disposition and one count of theft by failure to make required disposition of funds.
The defendant and counsel entered a plea agreement with the AGO. He pleaded guilty to one count of theft by deception. The other case was dismissed as part of the plea agreement.
The plea agreement stated that on or between Dec. 13, 2007, and Jan. 17, 2008, Besana stole $1,490 in cash from Hair.com.
Police said Besana stole the rental payment that his employer asked him to collect from one of the building tenants.
The employer twice asked Besana if he was able to collect the rental from one of the tenants, but the defendant stated that the tenant was off island.
On Jan. 11, 2008, the employer learned from a friend that the tenant had already paid the rent and that Besana got the amount.
