Man convicted of beating man over missing cow
A man was convicted of assault and battery after he beat up a man over a missing cow in Kagman III.
Superior Court Associate Judge Ramona V. Manglona accepted defendant Herman I. Somorang Jr.’s guilty plea to assault and battery.
Manglona sentenced the 40-year-old Somorang to one year in prison, all suspended except for eight days.
Manglona gave the defendant credit for the time he has already served in jail and placed him under one year probation.
The judge ordered Somorang to pay a $500 fine, a $25 court assessment fee, and a $100 annual probation service fee.
She also required the defendant to pay restitution in an amount to be determined by the Probation Office.
The Attorney General’s Office charged Somorang with assault and battery, and assault with a dangerous weapon.
The defendant and counsel Joaquin DLG Torres signed the plea agreement. For pleading guilty to assault and battery, the AGO agreed to dismiss the remaining charge that was subsequently reduced to the lesser included offense of assault and battery.
The plea agreement stated that on April 12, 2008, Somorang struck Joey Mendiola Jr. in the face, causing injuries.
Detective Peter A. Aldan stated in his report that the assault happened when Somorang arrived at the residence of Mendiola in Koblerville 111.
The defendant asked Mendiola where his cow was, but the latter responded that he does not know anything about a cow.
Somorang went under a mango tree where he called Mendiola to approach him and asked him again about his cow.
When Mendiola again denied knowing anything about the cow, Somorang punched him in the jaw. The defendant then picked up a rock the size of a softball.
Mendiola ran to his residence, but the defendant chased him and threw the rock at him.
The victim was hit on the right ear, right temple and right cheek. He sustained a small laceration in the right ear, and bruising and swelling on the right temple. He also had small puncture wound on the right cheek.
Somorang then ran toward his truck and sped away.
