A police officer has been arrested for allegedly firing his personal gun and assaulting his brother in Garapan Sunday afternoon. Police Officer Nick Leon Guerrero was later released.

Department of Public Safety Commissioner Santiago F. Tudela said yesterday that Leon Guerrero has been put on administrative duty pending the outcome of the DPS Internal Affairs’ investigation.

“This case will then be forwarded to the Attorney General’s Investigative Unit for further investigation,” said Tudela in a statement.

Saipan Tribune contacted Leon Guerrero yesterday, but he refused to comment.

The commissioner said that on Sunday at 5:27pm, DPS received a report of a disturbance in the Garapan area.

Police officers were dispatched to the residence of Leon Guererro.

According to preliminary investigation, Tudela said, an argument took place between family members, prompting Leon Guerrero to discharge his personal firearm and assault his brother.

Leon Guerrero and his brother, Scott Leon Guerrero, were subsequently arrested and brought to the Department of Corrections for further processing.

At the time, the police officer was off-duty.

Leon Guerrero was assigned to the DPS Police Academy as a drill instructor.

The officer and his brother were later released. No one was injured as a result of the gunfire, Tudela said.

Tudela said Leon Guerrero fired his .223 rifle when his brother slapped him.

“This case has been forwarded to the Internal Affairs Unit pending further investigation,” the commissioner said.

Tudela told Saipan Tribune that sworn personnel at the department must maintain the highest standard of professionalism, whether they are on duty or off-duty.

“They have to be professional and they have to maintain their conduct,” he said.
