Court resets sentencing for ex-Marpac GM—again
The federal court has again postponed the sentencing of a former Marianas Pacific Distributors general manager who admitted to defrauding Marpac of $520,000.
U.S. District Court for the NMI Chief Judge Alex R. Munson on Wednesday reset the sentencing of Joseph Vincent Santos to Oct. 28, Tuesday, at 11am, after the parties in the case filed a stipulation.
The sentencing was supposed to be held today, Friday. Under the stipulation, Santos’ lawyer, Colin M. Thompson, and assistant U.S. attorney Beverly McCallum agreed to reschedule it to Oct. 28.
In approving the stipulation, Munson said the prosecution and the defense counsel have diligently worked to acquire all of the information that the court requested.
Munson said the requested information was collected from third parties, compiled and delivered to Thompson last week.
As a franchisee of Anheuser-Busch, MARPAC sells beer products to retail vendors on Saipan.
The U.S. government alleged that between January 2003 and April 2006, Santos made a total of $521,813.40 in unexplained cash deposits into four separate bank accounts.
The prosecution said in that period Santos “devised a scheme and artifice to defraud Marpac and for obtaining money and property by means of false and fraudulent pretenses, representations and promises.”
In September 2007, Santos pleaded guilty to mail fraud.
The sentencing was originally set for Dec. 11, 2007, but has been reset eight times already.
Santos remains at liberty under the same terms and conditions as the court had previously set.
