Superior Court Associate Judge Ramona V. Manglona has imposed a one-year prison term on a man who was among the group that burglarized the Roshi’s Department Store in Kagman and ransacked the establishment of a huge amount of clothing and other items worth $5,961.25.

Manglona sentenced Roman Torres Cabrera Jr. to five years imprisonment, all suspended except for one year, with credit for time already served in jail from March 20, 2008.

Cabrera, 41, is expected to complete the prison term no later than March 20, 2009.

After completing his sentence, the defendant will be placed on four years of probation.

Manglona ordered Cabrera to pay a $2,000 fine, $100 in court assessment fee, and $100 in annual probation service fee.

The judge said the defendant shall pay his pro-rata share of the $5,961.25 in restitution to Roshi’s Department Store for the stolen items and damaged bathroom window.

She ordered the Office of Adult Probation to prepare a pre-sentence investigation report only as to the restitution amount.

Manglona said the defendant shall perform 200 hours of community service.

Cabrera was also directed to write a letter of apology to the store.

Last March, the Attorney General’s Office charged Cabrera and Julian Muña Sablan with burglary, theft, and criminal mischief.

Cabrera entered a plea agreement with the government. He pleaded guilty to burglary. The remaining charges were dismissed.

The plea agreement stated that on Feb. 28, 2008, the defendant burglarized Roshi’s Department Store.

According to the charging information, Cabrera and Muña broke into the store by damaging the bathroom window and frame. They then stole assorted merchandise.

According to a police report, the burglary was discovered when the store manager reported to work in the morning of Feb. 28.

Among the stolen items were several cartons and packs of cigarettes, a large amount of clothing, ball caps, wristwatches, and other items.

DPS later received a tip from a person as to who were responsible for the burglary.

Police learned that aside from Cabrera and Sablan, there were three others involved, including two juveniles.
