Man gets 15 months jail term for ‘ice’ possession
The Superior Court has imposed a 15-month jail term on a man who was arrested last year on charges he was selling crystal methamphetamine or “ice.”
Associate Judge David Wiseman on Tuesday sentenced Vicente Q. Falig to five years in prison, all suspended except for 15 months, for possession of a controlled substance.
Wiseman gave Falig credit for the time he already served in jail from Dec. 29, 2007 to Jan. 9, 2008.
The judge ordered the defendant to start serving the jail term at the Department of Corrections on Oct. 14, 2008 at 10am.
After completing the jail term, the defendant will be placed on five years of supervised probation.
Wiseman required Falig to pay a $2,000 fine and $100 court assessment fee plus probation fee.
The judge also ordered the defendant to perform 200 hours of community work service.
In January 2008, the Attorney General’s Office charged Falig with two counts of trafficking of a controlled substance and two counts of illegal possession of controlled substance.
He and counsel assistant public defender Janet King signed a plea agreement with the government represented by assistant attorney general Rebecca Miller Warfield.
Falig pleaded guilty to possession of a controlled substance. The remaining charges were dismissed.
According to the plea agreement’s factual basis, on Aug. 23 and 24, 2007, on Saipan the defendant unlawfully possessed crystal methamphetamine.
Police Officer Norman S. Rasiang stated in his report that their “cooperating source” disclosed to members of the Drug Enforcement Administration, Drug Task Force on Aug. 22, 2007, that Falig is active in selling “ice” in Tanapag.
Rasiang said using the CS, Drug Task Force members were able to purchase $200 and $100 worth of “ice” from Falig on Aug. 23 and 24, 2007, respectively.
