Mother of boy hit by car sues driver
A mother has filed a lawsuit on behalf of her son who was injured after a vehicle hit him while he was on a bicycle in San Antonio.
Mercedes Denora sued the driver, Ji Eun Kim, for negligence.
Denora asked the Superior Court to order Kim to pay her damages for her son’s past and future medical expenses, mental anguish and physical suffering.
Attorney Eric S. Smith stated in the complaint that on Sept. 22, 2006 at 3:15pm, Kim was driving a 1998 Toyota sedan on the parking lot of the Alpex Wholesale Building in San Antonio.
Smith said that, at the same time, Denora’s son, a minor, was riding his bicycle in the parking lot.
The lawyer said Kim negligently backed her vehicle, hitting the boy with great force and violence.
The impact, Smith said, caused extensive internal and external injuries and severe shock to the boy.
As a result of the injuries, he said, the child had to be hospitalized and undergo surgery and other medical treatment.
“After defendant discovered that [the minor] occupied a position of peril, she failed to use ordinary care and failed to exercise all of the means within her control to avoid hitting [him],” Smith said.
