Two brothers sentenced for January riot
The Superior Court yesterday sentenced to prison two brothers who were involved in a clash with another group of men in Chalan Kanoa that resulted in one being stabbed.
Associate Judge David A. Wiseman sentenced Michael Torres Castro to a total of two years in prison for assault and battery, and criminal mischief, all suspended except for eight days. Wiseman gave Michael Castro credit for the time he has already served in jail.
The judge placed the defendant on one-year probation, required him to perform 200 hours of community service, and pay a $125 in fine and probation fee.
Michael Castro was also directed to pay a $1,745 restitution for causing damage to the car of Rose A.T. Hossain.
Wiseman sentenced Patrick Torres Castro to six months in prison, all suspended except for the three days already served, for riot.
The judge placed Patrick Castro on six months probation, required him to perform 50 hours of community service, and pay a $125 fine and court assessment fee.
Michael Castro was charged with assault with a dangerous weapon, assault and battery, and criminal mischief. Patrick Castro was charged with riot and assault.
Both entered a plea agreement with the government. Michael Castro pleaded guilty to assault and battery, and criminal mischief, while his brother pleaded guilty to riot.
The plea agreement stated that on Jan. 10, 2008, Michael Castro threw rocks at the car of Hossain, damaging it and its windows.
With respect to Patrick Castro, the defendant “assembled with two other persons and together by force, violence, loud noise and shouting placed others in fear and danger.”
Last June, presiding judge Robert C. Naraja sentenced two other brothers who were also involved in the clash.
Naraja sentenced Sipson K. Ludwig to three years in jail, all suspended except for eight months, without parole, for aggravated assault and battery.
Naraja sentenced Sos K. Ludwig to six months in prison, all suspended, for riot.
According to the plea agreement, on Jan. 10, 2008, Sipson Ludwig was involved in a fight with Patrick Castro and others.
During the fight, Sipson Ludwig caused serious bodily injury to Patrick Castro in the form of lacerations that necessitated treatment at the Commonwealth Health Center.
During the same incident, the agreement stated, Sos Ludwig “did assemble with Sipson Ludwid and Onochew Iata and placed others in fear by use of force, violence, loud noise, shouting or threats.”
