Another construction firm sues IPI for over $2M
Another construction firm has sued Imperial Pacific International (CNMI) LLC for alleged breach of contract and is asking the court to award them damages of over $2 million.
Modica Pro Limited’s Corrado Modica and project manager Glenn Patrick Bell filed a lawsuit against IPI for breach of construction and employment contracts with the Superior Court.
According to the plaintiffs’ lawyer, Joe McDoulett, his clients are entitled to damages totaling $2.6 million plus interest, and attorney’s fees.
The lawyer said IPI entered into a contract with Modica construction firm to complete the interior of the Imperial Pacific Resort and Casino in Garapan. McDoulett added that Corrado Modica and Glenn Patrick Bell entered into employment contracts with IPI to complement the construction contract between Modica Pro and IPI.
The contract, McDoulett said, provided for progress payments, and for payments for additional work performed for the benefit of IPI.
The original price of the construction contract was $2 million, the first $200,000 of which was to be paid upon the execution of the agreement.
However, IPI allegedly refused to honor its obligations to the plaintiffs.
Because IPI allegedly refused to honor its obligations, despite good faith efforts made by the plaintiffs to resolve the dispute, they sought enforcement from the court.
