Deportable alien waiting for repatriation arrested again

A deportable alien who was temporarily released from detention in July 2007 while her travel documents are processed has been waiting for her repatriation to China for about nine months now.

However, after failing to call Immigration as agreed for her temporary release, Immigration agents arrested respondent Miss Difang Xu on Monday.

Xu was taken to the Superior Court yesterday.

Attorney Perry B. Inos explained to the court that Xu’s failure to call Immigration was only a misunderstanding on the respondent’s part. Inos said the respondent has been calling her office.

Associate Judge David A. Wiseman imposed a $2,000 cash bail and ordered Xu to appear in court on May 22 at 1:30pm for a status conference.

Wiseman directed Xu to comply with the previously imposed pre-trial order release such as calling Immigration twice a week.

The respondent was among five Chinese persons arrested in December 2006 in a reported human smuggling attempt to Guam.

In January 2007, Wiseman found Xu a deportable alien after finding that the respondent conspired with others to exit the CNMI on a sea vessel and board the boat with the intent of entering or attempting to enter the U.S.

In July 2007, Lynch and Inos agreed to the temporary release of Xu pending her repatriation.
