Alien allegedly overstaying for more than a year now

The Division of Immigration has filed a deportation case against a Bangladeshi national who is allegedly an overstaying alien in the CNMI for more than a year now.

With the filing of the case, Superior Court associate judge David A. Wiseman ordered Chandran U. Kandiah to appear in court on March 27 at 1:30pm to explain why he should not be deported from the CNMI.

Immigration investigator Nicolas R. Reyes said that Kandiah’s nonresident worker’s entry permit issued July 10, 2006, already expired on Feb. 4, 2007.

Reyes said the respondent did not file any labor case and was never issued any temporary work authorization to get a new job.

The investigator said the Bangladeshi national failed to submit a new application for his nonresident worker’s permit at the Department of Labor Processing Section.

He said Kandiah also did not submit a nonresident worker’s application for consensual transfer to another employer.

“The respondent has failed to comply with the terms of his entry and is therefore a deportable alien pursuant to Commonwealth law and regulation,” Reyes alleged.
