Alien with student permit is nabbed for overstaying

Immigration agents recently arrested for allegedly overstaying in the CNMI a 35-year-old man who applied for student entry permit under the Saipan University.

Mingnan Jin has been overstaying in the CNMI since June 16, 2005, according to Immigration Investigator Richard T. Lizama.

Superior Court Associate Judge Ramona V. Manglona imposed a bail of $100 cash and $900 in unsecured bond for Jin’s temporary release.

Manglona ordered the respondent to appear in court on Nov. 9 at 1:30pm to explain why the court should not order his deportation.

In court papers, Lizama stated that Jin entered the CNMI under a short-term entry permit that expired on Oct. 8, 2003.

Lizama said Jin applied for a student entry permit under the Saipan University, but it was never approved because the university never existed.

Labor issued a temporary work authorization for Jin on Dec. 17, 2003. On June 16, 2005, Labor issued a memorandum to allow the respondent to look for a permanent employer and submit an application for a one-year nonresident worker entry permit, the investigator said. Lizama said Jin failed to submit such application.

Jin was recently found at a barracks in Chalan Kanoa where Immigration agents were serving an arrest warrant on a different person. Jin was arrested for failure to show a valid entry permit.

About 88 persons from China were reportedly lured in 2003 to enroll at the Saipan University through false representations and promises about the education and facilities at the university and the students’ ability to obtain work in the Commonwealth. SU’s founder, Park Soon Kyung, was subsequently convicted and sentenced in federal court.
