Court orders voluntary deportation of tourist

Superior Court Associate Judge David A. Wiseman has ordered the voluntary departure of an overstaying Chinese tourist.

Wiseman said respondent Chen Wenlong shall be transported to the airport by an Immigration agent and removed from the Commonwealth.

Wiseman said the bail for the temporary release of Chen is reduced automatically to zero dollar upon the presentation of a repatriation ticket and valid passport or travel document by investigators at the Department of Corrections.

The judge said the respondent shall remain in DOC custody until he can be transported to the airport for his repatriation flight.

Chen and his counsel signed an agreement with the government for his voluntary departure.

Labor records indicate that Chen entered the CNMI on Aug. 15, 2004 under the visitor short-term entry permit that expired on Sept. 14, 2004.

The respondent extended his permit into long-term tourist status, which expired on Nov. 14, 2004.

Chen, however, was allegedly found following up for his nonresident work permit at Labor with a fake receipt (application fees voucher) in his possession. He was then referred to Immigration for investigation.

On April 7, 2005, Chen did not show up at the deportation proceeding, prompting the court to issue a $2,000 bench warrant for his arrest.

On Jan. 23, 2006, the respondent was arrested and the court imposed a $5,000 cash bail.
