‘CDA execs who resigned are officially out’
The four members of the Commonwealth Development Authority who have quit their posts do not need to wait for the governor’s formal acceptance of their resignations, according to the Fitial administration.
Citing advice from the governor’s legal counsel, press secretary Charles P. Reyes said yesterday that a board member ceased to be part of CDA once he had tendered his resignation.
CDA board members Marcie Tomokane, Vincent Calvo, Manuel Sablan and Pedro Itibus have issued their resignations over a week ago, in compliance with the governor’s request. But they continue to sit on the board, having taken the position that they will remain members until the governor has formally accepted their resignation.
“This is not true. There is no need for the governor to officially act on their resignation. Their resignation became effective on the date they were made,” Reyes said.
A portion of 4CMC Section 10304, which created CDA, reads: “An appointed [CDA] member may at any time resign his office by notice in writing to the governor. Upon resignation, removal or expiration of the term of the appointment, the member shall cease to sit on the board and shall not be included in a quorum count.”
Reyes also maintained that, based on this provision, the CDA board no longer had a quorum and should stop conducting meetings.
The CDA board of directors is a seven-member body. At least five members are needed to form a quorum.
Reyes also reiterated the governor’s call for the rest of the CDA board members to tender their resignation “and allow the governor the opportunity to make new appointments.”
