Man gets 3 years for raping ex-girlfriend

The Superior Court imposed a three-year prison term on a man accused of raping his former girlfriend after she refused to make love with him at her residence in Garapan.

Associate Judge Kenneth Govendo sentenced Phillip Ansa Mino to six years in prison, all suspended except for three years without eligibility for parole, for sexual assault in the second degree.

Mino will be placed on three years of probation after completing his prison term.

Govendo ordered Mino to pay a $1,000-fine plus court assessment and probation fees, and required him to perform 200 hours of community work service.

The judge directed the defendant to undergo counseling evaluation, write a letter of apology to the victim, and prohibited him from consuming any alcoholic beverages during his probation.

Govendo encouraged the defendant to pursue a General Education Development program.

Mino was ordered to register as a sexual offender 30 days prior to his release from prison and required him to submit to an HIV test.

In addition, Govendo said Mino shall pay child support, to be established by his ability to pay after release from jail.

The plea agreement stated that on Jan. 31, 2005, the defendant “did unlawfully engage in sexual contact with the [victim] without her consent.”

The Attorney General’s Office charged Mino with trespassing, assault and battery, disturbing the peace, sexual assault in the first degree, sexual assault in the 2nd degree, and resisting arrest.

The defendant and counsel Joseph James Norita Camacho entered a plea agreement with the government, represented by Chief Prosecutor Jeffery L. Warfield Sr.

Mino pleaded guilty to sexual assault in the second degree. The court dismissed the remaining charges pursuant to the plea agreement.

According to Detective Andrea Ozawa in her report filed in court, Mino forced himself on the woman after he asked her to make love with him and she refused. Mino only stopped when their baby woke up. The victim went outside the apartment and asked a friend to call the police.

Mino allegedly resisted arrest when a police officer put handcuffs on him.

The victim told police that since they were separated in 2003, Mino had forced her to have sex with him thrice.
