Wiseman calls ex-convict menace, sends him to jail

Superior Court Associate Judge David A. Wiseman has sent to prison for 60 days an ex-convict whom he called a “menace to society” for committing another crime.

Wiseman said Joseph Emul is a career criminal offender, having been convicted no less than six times for various offenses all involving physical violence.

“Unfortunately, he has never served more than 60 days in jail for any of the offenses,” said the judge in sentencing Emul.

Wiseman said he believes that Emul should he incapacitated or removed from society for the maximum period of time allowable under the law as he is a menace to society.

However, the judge noted, he does not believe that the latest case of stealing a machete, a shovel and some window frames is the appropriate case for such sentence due to a variety of factors in the government’s case.

Wiseman said Emul was informed that he would be deported and would be meted a maximum sentence in any future conviction.

The defendant pleaded guilty to theft.

Emul was sentenced to one year in jail, all suspended except 60 days. He will be placed on 10 months probation after completing the jail term.

The judge required him to pay a $100 fine, $300 in restitution, and $25 in court assessment fee plus probation fee.

Emul was also directed to donate $100 to the NMI Crime Stoppers Program and perform 50 hours of community work service.

The prosecution said that on May 23, 2005, Emul stole a puppy, a machete worth $20, two commercial type shovels worth $32, and four commercial type window frame worth $1,200.

Moots said the stolen puppy and the items belonged to a Goni Osman.
