Displaced worker of Mariana Fashions allowed to transfer

The Department of Labor has allowed one of those displaced workers of the defunct garment manufacturer Mariana Fashions Inc. to transfer to a new employer.

Labor’s Division of Administrative Hearings Officer Herbert D. Soll said Quan Ying Hai is not at fault in the circumstances and may transfer within 45 days.

Soll determined that Mariana Fashions submitted a renewal contract for Quan, whose contract was then nearly ending.

Soll said the submission was deficient and a notice of deficiency was sent to Mariana Fashions.

By the time the notice arrived, the company already shut down its operations on Saipan.

Quan had found a new employer and could have transferred, but her name was not included in the Labor case that brought transfer relief to other employees of Mariana Fashions, the hearing officer said.

The hearing of Quan’s case was held last Wednesday.

Mariana Fashions, La Mode Inc. and Sako Corp. closed business in 2005, while other garment manufacturers reduced their workforce.

A thousand workers were reportedly displaced by the closure of the three factories. (Ferdie de la Torre)
