Public School System legal counsel Karen Klaver has reconsidered her employment at the NMI Retirement Fund.

Fund administrator Karl T. Reyes said yesterday that Klaver informed the agency that she would not be able to work for the Fund because “it’s wrong timing.”

Klaver earlier submitted her application to work as legal counsel for the Fund. In a meeting before Christmas, the Fund board decided to hire her.

Reyes earlier said that Klaver was one of three lawyers who responded to the Fund’s job vacancy announcement.

Shortly after the board’s decision, Reyes said that Klaver informed them that she would not be able to leave PSS until about February 2006 due to pending cases.

Yesterday, Reyes said the lawyer is declining to accept the Fund’s job altogether. “She declined,” he said.

He said it was a bit “disappointing.”

This came even as Fund officials continue to express their dislike against a law that exempts PSS from paying the increased contribution of 36.7 percent for five years.

The Fund board said that the measure is “unfair and discriminating.”

The Fund offers a maximum of $65,000 annual salary for a legal counsel position.

The Fund has been without an in-house attorney for two years now.

The Fund board’s decision to hire a lawyer came even as it plans to finally sue the government for delinquency in paying its employer’s contribution.

The central government has some $85 million in arrears.
