Court drops Iakopo’s case

The Superior Court has dismissed a criminal case against rugby and football player Stanley T. Iakopo over a biting incident at J’s Restaurant in Gualo Rai.

The court dismissed the charges with prejudice following a motion by the Attorney General’s Office to drop the case.

Dismissal with prejudice bars the prosecution from ever reinstituting the case.

Assistant Attorney General John Eaton moved to dismiss the case, citing that the victim left the island.

“The Commonwealth believes it is in the interest of justice to dismiss the case with prejudice,” Eaton said in his motion.

Iakopo was charged with three counts of assault and battery, two counts of disturbing the peace, and one count of criminal mischief over the incident at J’s Restaurant.

Then Chief Prosecutor David Hutton stated in the first information that on Dec. 31, 2004, the defendant pushed Miss Jo Ann T. Sablan.

Hutton said the 32-year-old Iakopo bit Frank C. Tudela on the face and ear.

The defendant also caused damage to a flower base at J’s Restaurant. Iakopo pleaded not guilty to the charges.
