Man sues couple for refusing to build house

A man has sued a couple for allegedly refusing to build a concrete house pursuant to their agreement.

Juan M. Cabrera, through counsel Douglas F. Cushnie, asked the Superior Court to order defendants Conrad Sablan and Virnaliza Sablan to pay him $72,656 plus $36,500 in liquidated damages.

Cabrera demanded a jury trial.

Cushnie stated in the complaint that on March 27, 2000 Cabrera and defendants entered into an agreement.

Cushnie said the agreement provides that defendants would construct a concrete house for Cabrera on a specifically described lot for a value of $72,656.

Defendants have failed and refused to construct the house, the lawyer said.

The agreement, Cushnie asserted, provides for the liquidated damages to be imposed at the rate of $25 per day if the house is not constructed and complete on or before Dec. 10, 2000.

The liquidated damages at the present time amount to $36,500, he added.
