Senate wants to scrutinize agencies’ rules and regs

The Senate passed last week a bill that gives the Legislature authority to review all the rules and regulations adopted by government agencies prior to implementation.

Senate Bill 14,100, authored by Sen. Henry H. San Nicolas, provides that no proposed rule, regulation, or amendment adopted by an agency pursuant to law shall become effective unless reviewed and approved by the Legislature.

The senator said he is concerned about the consistency of the guidelines with the law.

“[It is found] that a mechanism is lacking by which the Legislature monitors agency promulgation of rules and regulations to ensure that proposed rules, regulations, and amendments are consistent with the spirit and intent of the statute from which the rules, regulations, and amendments are derived,” he said.

He said the bill allows for legislative scrutiny of proposed agency rules within a 30-day period before any such rule, regulation or amendment becomes effective.

San Nicolas’ bill aims to amend 1 CMC section 9115 to impose the legislative review of agencies’ rules and regulations.
