Teacher denies harassment of resto owner

A teacher who was sued by a businessman operating the Shark’s Fin Restaurant in Chalan Kanoa yesterday denied allegations that he was harassing the trader by blocking the restaurant’s parking lot on several occasions.

While James Feger admitted that he blocked the parking lot with objects such as loads of corals and huge rocks, he said that the land belongs to his wife, Barbara B. Feger, who does not get paid for Ta Bun Kuy’s rent of the property.

Feger said his wife does not even get paid for the lease of the 418-sqaure meter lot where the restaurant stands.

He claimed that his wife and the Bermudes family estate co-own the lot with Ray “Falcon” Bermudes. He claimed that a separate 345-square meter lot, part of which is being used by the restaurant for parking spaces, actually belongs to his wife Barbara.

Ta filed with the Superior Court a civil action that sought a court injunction preventing Feger from “trespassing” into the parking lot. The suit is seeking compensatory and punitive damages against Feger.

In the suit, Ta’s lawyer, Reynaldo Yana, asserted the trader’s right of easement to use the lot for parking purposes for himself and his customers, saying that the businessman acquired interests over a land lease from one Tsu Ming Sheu.

Yana said Sheu had earlier entered into a lease agreement with Falcon, who acted as agent on behalf of Franklin Mendiola Bermudes, the property’s original owner.

Feger said, though, that Franklin Bermudes never authorized Falcon to lease out the property. Feger alleged that Falcon had forged documents that purport to authorize the latter to enter into transaction regarding the Bermudes family properties.

In a telephone interview with Bermudes by this paper’s editor, he denied authorizing Falcon to transact any business in his name and affirmed that Falcon had used forged documents in his transactions related to the Bermudes’ lots.
