MPLA sues farmer for unpaid rent

The Marianas Public Lands Authority yesterday sued a farmer after he failed to pay rent for some 25 hectares of agricultural land in San Juan, Marpi.

The MPLA said David T. Camacho has refused to vacate the property, even though his agricultural grazing permit from the agency has already expired.

In documents filed with the Superior Court, MPLA attorney Matthew Gregory asked the court to compel Camacho to pay the agency holdover rent. The MPLA also wants to recover possession of the land.

In the complaint, Gregory stated that MPLA leased out the property to Camacho when it issued the permit on June 6, 1988. The complaint said the one-year permit was renewable annually, but the lease term should not exceed 15 years.

It said the permit expired and Camacho owes the MPLA back rent. Gregory did not specify in the complaint the date when the permit actually expired.

On Feb. 9, 2005, though, the MPLA delivered a final notice to Camacho and requested the farmer to vacate the land within 15 days.

“Despite demand to quit and surrender the premises, defendant refused to vacate and is still occupying the premises until the present time,” the complaint stated.

It said Camacho should also be liable for damages and costs incidental to the court action.
