Court sets $1,500 bail for illegal alien

The Superior Court yesterday imposed a $1,500 bail for the temporary release of an overstaying nonresident worker who is now facing deportation.

Yun Gao, a 30-year-old Chinese citizen, was brought to court on allegations that she had failed to comply with the requirements and conditions of her entry to the Commonwealth.

Yun, who arrived in the islands on Nov. 1995 to work as a garment worker, had no legal status in the CNMI since her contract with her last employer, Micro Pacific Inc., expired last year, according to the Attorney General’s Office.

Assistant attorney general Eric O’Malley said Yun did not file any complaint at the CNMI Department of Labor or at federal agencies such as the U.S. District Court and the Equal Employment Opportunity Commission, after her latest work permit expired on Sept. 9, 2003.

She also does not hold a temporary work authorization. Neither has she submitted an application at the Labor Department for a consensual transfer.

During the bail hearing yesterday, the court ordered Yun to pay a $1,500 bail for her temporary release. She was also told to return to court whenever required to do so, obey all CNMI laws, stay away from all seaports and airports, and call thrice a week to the Division of Immigration.
