Measure calls for ban on sale of used tires

The sales or importation of used tires may soon be prohibited in the Commonwealth after a bill introduced in yesterday’s House session proposed that it be made unlawful.

According to the proposal, importing or selling of used tires would be deemed illegal within 120 days after the Act becomes a law.

The bill, however, indicated several exemptions, including the use of used tires for agricultural motor vehicles; used tires on imported vehicles; used tires with a U.S. DOT identification number; and retread tires.

If passed, violators may be assessed a penalty of not more than $5,000 per day per violation.

“In determining the amount of any penalty assessed, the attorney general shall take into account the nature, circumstances and extent of the violation,” according to House Bill 14-212.

The bill also included that the attorney general shall take into consideration any prior history of such violations and the degree of culpability.

The proposal was introduced by Rep. Ray Yumul.
