Company cited for lack of an excavation permit

A company was recently ordered to stop all its earthmoving activities for lack of a necessary permit from the Division of Environmental Quality.

In a notice issued to H.S. Lee Construction Co. Inc., DEQ director John I. Castro said the company violated DEQ’z earthmoving and erosion control rules and regulations that prohibit grading, filling or clearing of vegetation without a DEQ earthmoving and erosion control permit.

DEQ said that on June 11, DEQ personnel received a complaint call from a resident west of Lake Park Apartments in Susupe.

“Onsite, they observed ongoing earthmoving activities. They also observed a small excavation consisting of electrical lines leading to the apartments,” Castro said.

Castro asked the construction firm to immediately cease and desist all earthmoving activities at the project site. He said the activities may not resume until it has received an amended earthmoving and erosion control permit.

At the same time, DEQ required the company to consult an engineer and implement an approved temporary erosion and stormwater control measures or structures within the project site.

DEQ also asked the company to schedule an inspection on the implementation of the approved temporary erosion and stormwater control measures or structures.

The company is also required to meet with the DEQ director and the wastewater branch staff to discuss the matter.
