Four sue insurance firm

Four men, all citizens of the Philippines, sued a travel agency for damages stemming from a vehicular accident that occurred in July of this year.

Rolando Lagartos, Sebastian Tubale, Francisco del Amen and Reynaldo Deguiday filed the damage suit in the U.S. District Court yesterday against Civil Travel Services Co. Ltd.

They did not indicate how much they are demanding as compensation, saying only in the complaint that the amount for special and punitive damages as well as other relief will be proven during the jury trial they are seeking.

The complaint, filed by their lawyer David G. Banes, named Yu Yun Lim as defendant as he was driving the van owned by Civil Travel that collided with the plaintiff’s car.

It alleged that Mr. Lim was an “unfit driver” and that Civil Travel was “reckless” in employing and retaining him as the accident caused injuries and damages to the four men.

They claimed in the suit to have suffered physical injuries requiring hospitalization as well as wage loss and loss of future earnings and earning capacity as a result of the accident.

Due to Mr. Lim’s “recklessness and gross negligence,” the plaintiffs continue to suffer “severe and permanent physical and mental pain and anguish,” the complaint stated.
