New law on guest workers protection

As part of government efforts to ensure protection of nonresident workers in the islands, Gov. Pedro P. Tenorio has signed into law a Senate-sponsored bill aimed at ensuring that employers comply with existing labor laws.

Public Law 11-123 allows the Division of Customs to deny the issuance of “Certificate of Origin” on goods manufactured in any garment factory found in violation of the Nonresident Workers Act or the Commonwealth Minimum Wage Act.

Mr. Tenorio however questioned the legality of the customs division’s discretionary authority to deny a “Certificate of Origin” for apparel products from a garment factory found in violation of the Saipan Garment Manufacturers Association Code of Conduct.

“The Garment Association is a private, voluntary organization comprised of some, not all, of the garment manufacturing entities in the CNMI,” the governor said.

He stressed his concerns on the appropriateness of a delegation of a law-making authority to any private party.
