Ex-employee seeks $5 million from Tinian Dynasty

A former employee of Tinian Dynasty Hotel & Casino is seeking $5 million in damages against the company as she held her ex-employers accountable for the death of her unborn child.

Benselin John, who used to work as a kitchen steward in the New Staff Canteen, slipped three times and had a miscarriage that resulted in her child’s death.

According to the complaint, the casino has managed its operations in such a way that it allowed unsafe work conditions in a kitchen that resulted in nine employees slipping and falling down.

When she was employed at Tinian Dynasty, John washed and prepared dishes, including pots and pans and the kitchen utensils, used in the preparation of meals for all the employees.

At all times in May 1998 and in the previous months, the floor in the kitchen was slippery due to leaking pipes located under the sink. The water laced with dish washing detergents, grease and cooking oil from pots and pans overflowed from the kitchen sinks. A defective floor drainage system also contributed to the slippery floor conditions, John said.

Sometime in May 1998, Ms. John slipped and fell injuring her legs and back. Again, in the middle part of May last year, she slipped and fell causing her to suffer from backache and headache.

After the second incident, Ms. John requested to be transferred out of the slippery and unsafe conditions of the kitchen area. But the management did not act on her pleas.

The hotel management said it will place a floor mat in the kitchen area, a promise that was never kept.

Again, Ms. John slipped and fell in the same area for the third time. This led her to suffer severe neck, shoulder, lower back and abdominal pains and injuries as well as severe headaches.

The complaint said Tinian Dynasty failed to provide a safe work place for her and her child Baby Mendiola by maintaining the staff kitchen and the adjacent areas clean.

Tinian Dynasty allowed the slippery and unsafe conditions in the kitchen area to continue despite repeated and adequate warnings, the complaint said.
