Further stay of punishment for 31 minor offenders sought
The Public Defender’s Office and the Department of Public Safety yesterday asked the Superior Court to further extend the stay of punishment for 31 defendants convicted of minor offenses pending resolution of the jail issue.
Assistant Public Defender Daniel Bowen and DPS legal counsel Barry Hirshbein submitted for court’s approval a stipulation agreement to postpone the date on which the convicted offenders would be required to report to the Division of Corrections.
Under the agreement between the Public Defender’s Office and DPS, the probation period for the offenders would be extended “should any of the defendants’ probation expire while this matter is pending.”
The offenders, most of whom were sentenced to a maximum of three-days in jail for traffic violations, were originally scheduled to report to DOC to serve their sentence last August.
Superior Court Associate Judge Timothy Bellas had agreed to stay the execution of sentence for the defendants until Aug. 27. Their sentences were again stayed until Oct. 20.
PDO and DPS have agreed to seek further stay of the punishment until the Superior Court acts on PDO’s complaint about the inhumane condition in the correctional facilities in Susupe. (Mar-Vic Cagurangan)
