6-month prison term for entering house and touching sleeping girl
Kimo Einat William, 22, was slapped with a six-month prison term for breaking into a neighbor’s house in China Town and rubbing the thighs and buttocks of a 16-year-old girl.
Superior Court Associate Judge David A. Wiseman sentenced William on Wednesday to six months imprisonment for disturbing the peace. Upon his release, he will be put on probation for a year.
William is prohibited from having any contact with the victim and ordered to stay away from her house and school.
Wiseman noted that the allegations are serious and that the Office of the Attorney General originally charged William with sexual assault in the second degree and other charges. The charges were later amended to assault and battery, and finally only disturbing the peace.
The OAG initially recommended a suspended sentence as part of a plea deal. Wiseman rejected the deal as too lenient.
Assistant attorney general Barbara Cepeda said that William entered the bedroom of his neighbor at night while the girl was asleep and rubbed her thigh and buttocks, causing her to wake up and scream for help.
The prosecutor said Williams admitted that he had been drinking alcohol prior to the incident.
William’s lawyer, Joaquin Torres, recommended a one-year probation sentence, saying his client has no prior conviction and has accepted responsibility and is remorseful.
Before the sentence was handed down, William apologized to the court.
Police said a burglary disturbance at a house in China Town was reported to the Department of Public Safety on Sept. 7, 2014, at 4:14am.
The victim’s father told the responding officers that someone entered his daughter’s room and touched her legs while she was asleep. When one officer met with the girl, she was crying and appeared to be nervous.
The girl told police she woke up when she felt someone rubbing her left thigh toward her buttocks. When she opened her eyes, she saw a man sitting on the bed beside her and recognized him as William, who stays across the street from their house.
When the girl screamed, William covered her mouth with his hands. Her scream, however, woke up her grandmother, who then opened the door to her room.
William ran out to the balcony, jumped down, and ran toward the jungle area beside the house.
Police detective Simon T. Manacop stated that William claimed he was only supposed to “spy on the girl.”
