2 cousins say Barpery sexually assaulted them in motel
Two cousins testified in Superior Court yesterday that security guard Parvez MD. Barpery sexually abused them in separate incidents in May 2013 at a motel in San Jose while they were still minors.
Barpery’s former girlfriend, Daisina Suda, also took the witness stand and told the jury how Barpery allegedly sexually assaulted a 17-year-old girl in front of her inside the motel.
Barpery, 44, is on trial for one count of sexual assault in the first degree and disturbing the peace. The charges involve one victim only.
Barpery’s trial will resume today, Tuesday. Associate Judge Joseph N. Camacho is presiding over the case.
Assistant attorneys general James McAllister and Margo Brown are prosecuting the case. Attorney Daniel Guidotti is counsel for the defendant.
The alleged victim, who is now 18 years old, testified that Suda and Barpery brought her and her 3-year-old brother to San Jose Motel in May 2013.
The alleged victim said that Suda and Barpery drank several cans of beer inside the motel. When her brother went to take a shower, she said Barpery started kissing her and removed her clothes, but she resisted.
She said Barpery yelled at Suda, who was next to them, then sexually penetrated her. The alleged victim said the sexual assault lasted about 10 minutes and that she was yelling, crying, and screaming the whole time.
She said Barpery only stopped when she screamed real loud. “I went to the restroom. I cried there,” she said.
The alleged victim said when she came out of the restroom later, Suda, Barpery, and her brother were no longer there. She said she saw blood on the bed sheet and that it was her first time to have sex.
She said Suda, Barpery, and her brother later arrived, bringing food with them.
The alleged victim said she neither called the police nor went to the hospital because since that incident, Suda would call her, asking her if she told anyone about it. She said she eventually told Suda’s sister about the incident in November 2013.
The alleged victim’s 17-year-old cousin also testified that in May 2013, Suda and Barpery also brought her to the same San Jose Motel, where three of them were drinking beer and vodka.
She said when Suda left to buy something at a store, Barpery asked her to have sex with him but she refused.
When asked what happened next, the 17-year-old girl covered her face with her left hand and did not reply. A court marshal handed her a glass of water.
After a few minutes, the teenager said that she was drunk at that time and that Barpery took advantage of her by holding her hands and having sex with her. She was only 16 at the time.
Suda, 41, said that Barpery was her boyfriend from December 2012 to September 2013. She said Barpery was nice to her and her children during the first few months of their relationship. It was in February 2013 that Barpery allegedly became abusive and controlling.
Suda said she, Barpery, the alleged victim, and her brother went to the San Jose Motel in May 2013. While there, Barpery allegedly said he and the alleged victim should marry so he will get an immigration status.
Suda said Barpery later stated he wants to sleep with her and the alleged victim.
“I didn’t say anything because I’m scared of him,” Suda said, adding that the defendant would threaten to kill her and her children.
While the boy was in the shower room, Barpery started kissing the alleged victim so she got mad and told him he’s sick, Suda said.
Suda said the alleged victim was crying and struggling as the defendant sexually assaulted her.
She said Barpery yelled at her to hold the victim’s feet.
“I was scared. I was crying too,” Suda said.
Suda said Barpery reminded her not to tell anybody about the incident or he would kill her and her children.
“We were scared. He’s really abusive,” she said.
Suda admitted that she was Barpery’s co-defendant and that she signed a plea agreement and pleaded guilty to disturbing the peace only.
“I want the truth to come out,” Suda said, adding that even without the plea deal it will not change her testimony.
Suda said one time she wanted to stab herself with a knife because she blamed herself for not being strong.
Suda’s sister Trasy also testified that the alleged victim told her in November 2013 that Barpery raped her inside a motel.
The government’s first witness yesterday was police detective Isapen Bokuku, who took over the investigation from another police detective.
Bokuku testified how the investigation led to the arrest of Suda and Barpery in January 2014.
Bokuku agreed with Guidotti that she did not get any physical evidence in this case.
