Wiseman orders deportation of Elyeisar
Superior Court Associate Judge David A. Wiseman ordered yesterday the deportation of Akilino P. Elyeisar, a Chuukese convicted in the death of his girlfriend.
Wiseman issued the decision after Elyeisar signed a stipulation with the Attorney General’s Office in which he agreed to his deportation from the Commonwealth.
The judge asked Elyesiar if he indeed signed and understood the stipulation stating he is a citizen of the Federated States of Micronesia and a deportable alien.
The defendant replied in a low voice: “Yes.”
“I accept the stipulation. Mr. Akilino P. Elyeisar is hereby ordered deported from the CNMI,” Wiseman said.
Wiseman granted Elyeisar’s request to have his deportation take effect after a week in order for him to arrange his things and take care of other personal matters.
The judge also advised assistant attorney general Kevin Lynch to look into the concern of the Public Defender’s Office that, since Elyeisar had already completed his prison term in a criminal case and is only under custody because of the deportation case, the defendant should not be detained together with convicted criminals in the Department of Corrections.
Maria Igitol, in an interview with the Saipan Tribune, said they are very happy with the defendant’s deportation.
“It’s over. We are going to move on now,” said Maria Igitol, who is the sister of victim Vickyann Maratita Igitol.
Wiseman earlier imposed a $10,000 cash bail for the defendant’s temporary liberty.
In increasing the bail from $1,000 cash to $10,000 cash, Wiseman noted that, besides his aggravated assault and battery conviction, Elyeisar’s 1995 conviction for illegal possession of a firearm and ammunition case was also serious.
The government filed the deportation case Friday, a day before Elyeisar was set to complete his 22-month prison term for aggravated assault and battery.
Police had responded to a residence in Kagman on May 13, 2004, based on a call of a neighbor who suspected a domestic violence incident. Vickyann Igitol told responding police she just fell from a stool. Days later, however, she reportedly confided to her father that she was beaten up by the defendant. Igitol died a few weeks later.
