Judge drops case vs man accused of not paying his bill

The Superior Court has dismissed a criminal case filed against a man accused of not paying his nightclub bill in the amount of $385.

Associate Judge Juan T. Lizama dismissed with prejudice the information charging 37-year-old Raymond I. Duenas with theft of service.

Dismissal with prejudice bars the prosecution from ever re-instituting the case.

Lizama dropped the case following the request of the Attorney General’s Office to dismiss the matter.

Assistant attorney general Nancy A. Knox-Bierman stated that after review of the file and the current circumstances involving the victim and Duenas, the government concluded that “it is in the best interest of justice to cease prosecution of this case.”

Knox-Bierman said the government has obtained evidence suggesting that Duenas may not be the perpetrator.

Chief Prosecutor Jeffrey Moots filed the information on May 3, 2005 that charged the defendant with theft of service.

Moots alleged that on March 23, 2005, Duenas refused to pay $385 worth of drinks and snacks at the Moon Night Club in Chalan Kanoa.

Duenas pleaded not guilty.
