Man sued for allegedly kicking cop
The Attorney General’s Office filed charges yesterday against a teenager who allegedly resisted arrest and kicked a police officer.
Michaellyn P. Cabrera, 18, was charged with resisting arrest and assault and battery.
Cabrera, a resident of Chalan Kanoa I, was summoned to appear and answer the charges in Superior Court on Jan. 30, 2006, at 9am.
Chief Prosecutor Jeffrey Moots stated in the information that on Nov. 27, 2005, on Saipan, the defendant pulled her arm away from Police Officer Andrew Santos as the latter attempted to place handcuffs on her.
Moots said Cabrera also pushed the officer and kicked him in the stomach.
There was no explanation in court papers why Santos was arresting the teenager.
Santos is the same police officer involved in the fatal shooting of Donnald Sewel while the officer was responding to a fight in Gualo Rai on Dec. 11, 2005.
But the AGO, through Moots, concluded that the action taken by Officer Santos in that shooting incident was justified by the circumstances.
Moots said Santos acted in an “extremely professional manner” and in fact, based on the circumstances, he should be commended for his restraint.
In other court news, the AGO charged yesterday a 20-year-old man for allegedly stealing a mountain bike.
Ichnis Peter Kapwich was charged with theft.
Moots said that on Sept. 26, 2005, Kapwich stole the bike from Leopoldo Devanadera Pisano.
The defendant was summoned to answer the charges in court on Jan. 30, 2006 at 9am.
