Man sues another, company over road accident

A man has sued a company and its employee over a road accident that resulted in his injuries.

In a civil action at the Superior Court, Eduardo G. Gamboa seeks unspecified monetary damages against one Joseph Babauta Songsong and the latter’s employer, Western Sales Trading, Co.

Gamboa also impleaded Calvo’s Insurance Underwriters (CNMI), Inc. as defendant, saying that Western Sales Trading’s vehicle that was involved in the accident was covered by Calvo’s insurance policy.

Lawyer Danilo T. Aguilar said his client, Gamboa, was riding a bicycle on the right-hand portion of the outer northbound lane of Middle Road on Aug. 6, 2005 when the accident happened.

“While Mr. Gamboa was traveling on that road, a 2002 Ford Econoline cargo van operated by defendant Songsong attempted to pass Mr. Gamboa on his left hand side. During the attempted passing of the cargo van, the passenger side mirror of the van violently struck Mr. Gamboa’s bicycle or [his] left arm,” Aguilar said.

Aguilar said Gamboa was thrown from his bike and fell onto the ground in a violent manner, resulting in injuries. He said that Songsong, who was driving Western Sales Trading’s vehicle, violated traffic laws, citing results of a police investigation.

Aguilar said Gamboa suffered not only from the physical injuries, but also from mental and emotional distress and loss of enjoyment of life due to those injuries.

The lawyer also accused Western Sales Trading of negligence, alleging that the company should have known that Songsong was not sufficiently trained or skilled to drive the company’s cargo van.

He said the insurance company should also be liable for damages up to the limits of its insurance policy covering Western Sales Trading’s cargo van. (John Ravelo)
