…as firm seeks tenant’s eviction

A company filed with the Superior Court a lawsuit Wednesday that seeks to evict a Korean businessman from a leased commercial space in South Garapan, Saipan.

Batec Co. Ltd. filed the civil action after Yung Hwui Ko failed to voluntarily vacate a commercial space and pay for its rent.

Based on the complaint filed by Batec’s attorney, Danilo T. Aguilar, the businessman rented the space from Inchon Enterprises Inc. beginning January 2003. The lease expired after one year.

Batec, however, acquired rights over the commercial spaces from Inchon. Batec consented to Yung’s continued occupancy of his commercial space on a month-to-month basis until the company sent the businessman a notice of termination of lease on Oct. 8, 2004.

Aguilar said the notice gave Yung 30 days to vacate the premises, but the latter failed to comply with the notice up to now.

Aguilar asked the court to compel Yung to pay Batec the $800 rent from Oct. 8 to Nov. 8, plus double rental amounts of $1,600 for every additional month that the businessman fails to vacate the commercial space.
