Labor reverses permit denial for worke

The Department of Labor recently reversed the decision of Labor director Dean Tenorio to deny the Labor permit application for a nonresident worker.

The director’s decision was appealed by the nonresident worker Rogelio M. Samson and Saipan Ice and Water Inc. According to the Labor order, the permit application was denied because it was filed one week late.

“The company representative made an explanation that was deemed to be an excusable neglect by the Department,” the order read.
After reviewing the conditions of employment of the employee, Hearing officer Herbert D. Soll recommended that the application be processed, but only after the job description is revised.

Soll indicated that the job description and the required Job Vacancy Announcement be changed to that of a bottling helper and that a new JVA be published and submitted to the department within 30 days.

Saipan Ice and Water Inc. was also sanction the amount of $50 for the delay in filing the documents. The sanction must be paid before the new filing would be accepted.
