Superior Court Associate Judge Perry B. Inos yesterday acquitted a security guard of charges that he threatened a woman with a pick tool.

Inos determined that the government failed to prove beyond reasonable doubt that Lamberto Flores committed assault and disturbing the peace. Inos said he finds the testimony of the alleged victim “incredible” and questioned the credibility of the other witness.

“You are now a free man,” Inos told the 48-year-old Flores, who teared up as he sat beside his counsel, assistant public defender Douglas Hartig.

The Office of the Attorney General had alleged that on June 2, 2011, Flores assaulted a woman and disturbed her peace. Flores at the time was holding a pick that he used to backfill an exposed water pipeline at an apartment compound in Garapan.

The alleged victim reported that Flores had tampered with a water meter.

Hartig asserted that CUC cleared Flores of wrongdoing.
