U.S. District Court for the NMI Chief Judge Ramona V. Manglona on Monday granted the U.S. government’s motion to dismiss a criminal complaint filed against Mohammad Jahangir Miah, who allegedly masterminded a scheme of cashing fraudulent CNMI tax refund checks in grocery stores.

Assistant U.S. attorney Stephen F. Leon Guerrero asked the court to dismiss the complaint after an indictment was filed last week that charged Miah with violations similar to those charged in the this case.

The indictment charged Miah and his two alleged conspirators-Earl Eric Mirano and Cecilia Blas-with conspiracy to commit bank fraud.

FBI agents arrested Miah last March 19.
