42 nursing staff granted transfer relief
The Department of Labor has dismissed a complaint against an agency and simultaneously granted the complainants—42 members of the nursing staff—a 60-day transfer relief.
In a June 21, 2004 administrative order, DOL hearing officer Linn H. Asper said the nurses, who were employed by Saipan Employment Agency and Services or SEAS, had complained of delayed payment of wages in late 2003.
Asper said all wages owed the complainants have been paid in full.
He said both DOL and the complainants do not request any relief against SEAS “other than to effect the transfer of the complainants to the Department of Public Health.”
As such, Asper ruled that the case should be dismissed without imposing a fine or other penalties on SEAS when the transfer process is complete.
Currently, the nursing staff has temporary work authorization status with DPH.
The DPH terminated last year its contracts with agencies, including SEAS, in view of its shift to direct hiring effective Jan. 1, this year.
In the meantime, Asper said that SEAS is no longer legally or financially responsible for the wages or medical expenses of the complainants.
In his order, the hearing office said the complainants’ new employer should be able to file new labor permit applications for them within the 60-day period.
DOL said the job vacancy announcement for the complainants is waived “as long they remain in their present job classification at the Commonwealth Health Center.”

Victoria Pagsolinga, Mary Ann Acido, Nelson Batallones, Carolyn Castillo, Reynaldo Culala, Russel De Vera, Bernard Gaspar, Rodolfo Lenon, Ma. Ofelia Miguel, Nelson Pagaduan, Annette Quiambao, Elsie Ringor, Marian Santos, Dorothy Tabora, Charito Vicencio, Bella Almendras, Jaime Camero, Jr., Nelson Chiu, Rex Dacasin, Ailene Ferrer, Amefil Gonzales, Editha Magpili, Ana Marina Neri, Cherry Ann Panem, Veronica Ranola, Efren Sacopla, Veronica Servidad, and Brigada Tadilfa.
